Free divorce forms in California - where to get them and how to use

If you live in California and you are considering a divorce, you are very lucky to have available for free divorce forms for you. Right? Well. . . sort of.

California has issued a comprehensive set of forms for divorce that you can take in the superior court in your county or to download to California, the center of self-help law online. They are Adobe Acrobat fillable forms and you can download a free Adobe Reader from the Adobe website. (Theoretically, you can simplyfill them in by hand with a black pen, but the officials really hate that.)

So if the forms are free, why there are so many people that sell kits for divorce on the internet? Unfortunately, the central Californian self-help is not as useful as you think. I counted 138 different kinds of family law alone, and very few of them have instructions on how to fill them. Most of them do not apply to you, but you really have no way to be on those whocase. And they can be very, very confusing. Here's one of my personal favorites: Declaration Re Service Disclosure Statement. Only a lawyer can come up with a title like that.

Take a few recent studies. A study by a working group of pro SEE litigants (people) estimates that up to 60% of the population filing for divorce in California doing their own divorce. Another recent study estimates that up to one third of those whothink they got their divorce in Los Angeles has never done and do not know.

What happens here? People have access to free forms, but they do not get the knowledge they need to use them. If you do your own divorce, you will get some other resources to help you.

His book "How to Do Your Own Divorce in California" has been around for many years and has sold over one million copies. He has a good product and good reputation. The book also comes with a CD with forms and applications needed to fill them. You can find copies at your local bookstore or through its website at Nolo. Com. (A word of caution -almost all libraries in the state have a copy of this book, but it is best to get a new edition. California's changing forms twice a year and want the latest edition of the book.)

Press Sphinx - "How to file for divorce in California" - also a very good book, written by a couple of lawyers and regularly updated. The edition that I have not got a CD with forms, but a tear forms in the back. Again, if you do not have a writer type, you should downloadforms you need from the center of self-help rather than using a pen.

Alpha kits divorce in California, written by Kermit Burton - the author is a former law clerk and although there is not much explanation of the system as the two previous books, there are real examples of every form filled. Again, no CD with it, but it is nice to look at the forms and be sure that you have done well.

Bob Pickus, "" Divorce and family law in California "- the author isan attorney in Alameda and do clinics on the right of the family. There are no forms or instructions with it, but I recommend it. It has some very good, detailed discussions on all issues in divorce in California.

If you live in Los Angeles, you can go to court site above and download a document entitled "Procedural default manual processing and uncontested judgments Written by declaration under Family Code 2336th" As you can guess fromAs such, it is written in the Office of Swedish and it is just as dull as ditch water, but it tells you how you handle your divorce.

The first thing to know is what happens during a foreclosure. When it comes to foreclosure, there is a legal process that must be followed. There are two prominent phases within the foreclosure process; Pre-Foreclosure and Formal Foreclosure.

During the Pre-Foreclosure phase, the homeowner misses several mortgage payments in which the bank replies with late notices, phone calls, and eventually a notice of default. If arrangements can't be made to pay the back payments, interest, late fees and legal fees, the lender takes things to the Formal Foreclosure phase.

The Formal Foreclosure phase is where the lender files a foreclosure action in court. The court holds a hearing and issues a foreclosure order which gives the bank the right to sell the house. A legal notice is published in the local papers and the house is sold to the highest bidder at auction or the bank takes possession of the home.

Eventually, after a redemption period, the original homeowner is evicted from the home and notified of any outstanding debt still owed on the property. The lender can still come after the original homeowner for any outstanding debt still owed on the property in the form of a deficiency judgment.

The next thing the struggling homeowner facing foreclosure should know is the timeline for foreclosure. Here is the Mortgage Foreclosure Time Line provided by the Oakland County Housing Counseling and Homeless Service. This time line breaks things down on a month by month basis.

MORTGAGE FORECLOSURE TIME LINE

First Month Missed Payment

The first month you fail to make a mortgage payment your mortgage company is likely to contact you by mail and/or phone to inform you of your delinquent status.

Second Month Missed Payment

After missing a second payment, your mortgage company is likely to begin calling the contact numbers that they have for you in order to discuss why you have not made payment. It is important for you not to avoid their phone calls. Try to stay calm on the phone and explain to them your situation and what you are trying to do to resolve it. You still may be able to make one payment at this time to prevent yourself from falling three months delinquent.

Third Month Missed Payment

Generally, after the third payment is missed, you are likely to receive a letter from the mortgage company stating the amount you are delinquent, and that you have 30 days to bring your mortgage current. This is called a Demand Letter or Notice to Accelerate. If you do not pay the specified amount or make some form of arrangements by the date given, the mortgage company may begin foreclosure proceedings. They are unlikely to accept less than the total due without arrangements being made if you have received this letter. You still have time to work something out with the mortgage company.

Fourth Month Missed Payment

Now you usually are nearing the end of the time allowed in your Demand or Notice to Accelerate letter. When the 30 days ends, if you have not paid the full amount or worked out arrangements you will be referred to the Mortgage Company's attorneys. You will incur all attorney fees as part of your delinquency.

Sheriff Sale

In Michigan, the attorney will schedule a Sheriff Sale. This is the actual date of foreclosure. You will be notified of this date by mail, along with a notice taped to your door. This is NOT a move-out date! The Sheriff Sale will be scheduled approximately 6 weeks after the attorney receives your file. You have up until this date of sale to work out arrangements with the mortgage company or to pay the total amount owed (reinstatement amount).

Redemption Period

After the Sheriff Sale you enter your Redemption Period. Michigan State law requires the redemption period be no less than 30 days and no more than 1 year.The majority of redemption periods last six months provided the unit is occupied.You will be notified of your time frame on the same notice that states your Sheriff Sale date.

The West Orange Trail at 22 miles is the longest paved rail-trail in the Orlando area, passing towns, suburban areas, fields and woods. A portion of the trail runs near the shores of Lake Apopka, with several access points to the lake. Built on an old railroad alignment and owned by Orange County Parks and Recreation, it goes through downtown Oakland, Winter Garden, and Apopka. A short extension from the western terminus connects to the South Lake Trail.

Close to Orlando and Walt Disney World, the 12-15 foot wide West Orange Trail is popular for jogging, cycling, horseback riding, and rollerblading. It is used by over 55,000 people a month.

This is a world-class rail-trail hosting excellent facilities at "stations" (full-featured facilities) and "outposts" (limited amenities). An equestrian path, starting at Clarcona Horseman's Park, parallels the trail for 10 miles. While there are shaded areas, benches, and nearby amenities, this is Florida and it is recommended the rider bring plenty of water and sunscreen.

There are many access points to the West Orange Trail, including:

• County Line Station (also called Killarney Station) - off SR 50 west of Winter Garden. Parking, restrooms, water, snacks, playground, bike shop. Connector to South Lake Trail.
• Chapin Station (also called Winter Garden Station) - on Plant Street (CR 438) in Winter Garden. Parking, restrooms, water, playground, picnic pavilion. Two blocks from downtown Winter Garden with its restaurants, shops, museums, and bike shop.
• Apopka terminus - at route 435 and East Welch Road north of Apopka. No facilities, parking along the road and nearby restaurants and shops. Future extension planned.

Starting from County Line Station, the West Orange Trail heads east toward Oakland. A restored railroad bridge that spans the Florida Turnpike at mile 1 is a trail landmark. A short distance further, a shelter marks access to the Oakland Nature Preserve, which includes hiking trails and a boardwalk to Lake Apopka. Just past the next street crossing and adjacent to the trail is Briley Farm, home to assorted exotic animals, including Watusi cattle, zebras, wildebeest, and ostriches.

Next comes Oakland Outpost (water, benches), adjacent to quaint old downtown Oakland, where street parking is available. Continuing toward Winter Garden, the trail passes pretty scenery with moss-draped oaks.

Nearing mile 5, the West Orange Trail enters Winter Garden, with its restaurants, shops, and museums. The trail runs down the middle of Plant Street and features a fountain with benches; at any given time you might find art shows, entertainment, or other activities being held. Many people consider this western 5-mile section of the trail to be the most interesting.

Just past mile 5 is Chapin Station. The trail runs past Forest Lake Golf Course in Ocoee, to Ingram Outpost (mile 12, parking). The Apopka-Vineland Outpost (mile 14) has parking, a picnic pavilion, and water. The trail branches at mile 14.2, where riders can take the spur to Clarcona Horseman's Park or cross Apopka-Vineland Road and continue north to Apopka. The first mile past the road crossing offers one of the prettiest tree canopies in Central Florida.

Leaving the tree canopy, the trail runs mostly parallel to roadways and there is virtually no shade for the remainder of the ride. Apopka Station (Mile 19) parking, water, playground and picnic pavilion in the center of Apopka, a leading bridge players securely occupied by U.S. 441 and then another 3 miles to the north of Welch trailhead road.

West Orange Trail has something for everyone and will be flown to Central Florida.

As I relaxed in my seat, waiting for my flight home, at Shanghai International contemplating my last five weeks in China, I was distracted by an elderly couple attempting to constrain an over active toddler. The child, as I had learned was the custom, wore short pants with vertical slits toward the front and rear and no diapers.

Grandmother (I will call her) sensing that the child needed to relieve himself, swept the toddler off the floor and proceeded to carry him in the direction of a terminal trash can. As Grandmother began to position the toddler over the trash can, I heard shouts of consternation from three ladies wearing white uniforms and carrying brooms as they ran motioning frantically for Grandmother to stop what she was doing. As they converged on her reading what must have been the Chinese "Riot Act", they began pointing in the direction of the public restroom. Grandmother shook her head in acknowledgment and took the toddler down the hall to the bathroom. I thought, what an amusing encounter and returned to day dreaming about my China experience.

What I just witnessed was a curious brand of Eastern customs meeting Western, the old butting into the new, the rural adjusting to the urban.

Prior to my trip, China held a certain mystique, if not fear, for me. Red China, the term I was taught in grade school--the last bastion of Godless militarism which disdains all things western. Then Tiananmen Square happened. I began to hear about Fax machines and Cell phones. The students from Beida (Beijing University) demanding democracy, the statue of freedom--and then the bloody crackdown.

The China I saw bore little resemblance to the China I was expecting to see. Granted, I was steered mostly to the tourist areas, but I was often able to venture out among the people. Once bicycling with the masses going wherever the swarm took me. I had to mentally pinch myself frequently to believe I was in Communist China the land of over one-billion Chinese.

The work unit system (Danwei) was in full effect. Under this system there wasn't the incentive to work hard other than peer pressure. The work/reward relationship was based on the collective as opposed to the individual. Communism tends to protect the weakest link in the chain. It was common to see, for example, six female employees in a department store standing dutifully behind a counter smiling politely while one employee worked the cash register. It was typical to see an outdoor work crew digging a trench with shovels while a back hole sat idly nearby. How else can a government put to work one billion people?

When in China one understands why there is a one-child policy. I think to the Chinese the sheer number of them presses so poignantly on their psyche that no one dares to question the soundness of the policy; not to mention the price to be paid for violating this edict is harsh. If one has a second child, without permission, the family will not only be fined, but that illegally conceived child will not be eligible for medical insurance, ration of goods, or be able to attend primary school. Also, the mother, four months after giving birth, must submit to sterilization in the form of a tubal ligation.

China 1997 was a vibrant and dynamic place. They were in the process of celebrating the return of Hong Kong to the mainland. I don't know exactly what I was expecting, but it wasn't what I saw. China can't be summed up Correctly - everything is in motion. The next chapter will be written on. This proved to be the largest in the history of social change or catastrophic global impact.
